Information, not advice
Information on the Harris Defamation website is general in nature and does not constitute legal advice. You should seek formal legal advice before relying on the content from the Harris Defamation website. Harris Defamation does not guarantee the accuracy of the content on the Harris Defamation website or the suitability of content for your circumstances.
That applies to everything published here, including the articles, the claim checker and the descriptions of how defamation matters run. None of it takes account of any particular person's circumstances, and none of it is a substitute for advice from a lawyer who has been given the full facts. Reading this website, sending an enquiry or using the claim checker does not create a solicitor and client relationship.
Currency and jurisdiction
Defamation law in Australia differs between the states and territories and changes over time. Each article states the date it was last reviewed and the jurisdictions its main propositions apply to. We try to keep the content accurate and current, but we do not promise that it is complete, error free or up to date at the moment it is read, and we may change or remove content without notice.
The claim checker
The claim checker is an educational tool that runs through some of the questions a lawyer asks at the start of a defamation consultation. Its output is a general indication based only on the answers given, not an assessment of any claim or defence. Whether a claim or defence has merit depends on facts and documents the checker cannot see. No result from the checker should be acted on without advice.
Enquiries and engagement
Enquiries sent through this website are confidential and are used to check for conflicts of interest and to respond. We are not obliged to accept any enquiry or to act for any person. An engagement begins only when it is confirmed in writing, with a costs agreement and disclosure that comply with the legal profession legislation that applies. The initial consultation fee stated on this website is payable before the consultation and covers that consultation only. Costs for any further work are set out in writing before the work is done.
Liability
To the extent permitted by law, Gibbs Wright Lawyers Pty Ltd, trading as Harris Defamation, excludes liability for any loss or damage arising from the use of, or reliance on, the information on this website. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded. Liability limited by a scheme approved under Professional Standards Legislation.
